How Do I Qualify for an Expungement?

According to California Penal Code Section 1203.4 (Penal Code § 1203.4) An adult who was granted probation, completed all the terms of probation, and is no longer on probation, is eligible for relief under this statute. He or she must not be on probation, or serving a sentence, for any other offense, anywhere. Applicants must wait one year following a misdemeanor conviction before applying for expungement pursuant to Penal Code section 1203.4a.

What if I am Still on Probation? Can I Get an Early Expungement?

Many people who have been convicted of a crime find that once they have completed all the terms of their probation, other than finishing their probation time, they are ready for a fresh start as soon as possible. In these situations, you can petition the court for an early termination of probation. Once probation has been terminated, then you can petition for an expungement.
