Sacramento Expungement Attorney.

As if being charged and convicted of a crime was not bad enough, many people who have been convicted of crimes are surprised to find out how much a criminal record can haunt you later. Employment checks, Security Clearance, Mother-in-laws or significant others conducting investigation into your past, all create problems. Fortunately, the California Penal Code Section 1203.4 provides a way to have misdemeanor and infraction convictions retroactively dismissed. This law is intended to provide relief such that the defendant is “released from all penalties and disabilities resulting from the offense.” That is what we refer to as a Fresh Start. If you have a criminal conviction in your past you should call us immediately to have the case expunged or dismissed. There is no time like the present to put past mistakes in the rearview mirror, once and for all, and to get a fresh start on your life.

How Do I Qualify for an Expungement?

According to California Penal Code Section 1203.4 (Penal Code § 1203.4) An adult who was granted probation, completed all the terms of probation, and is no longer on probation, is eligible for relief under this statute. He or she must not be on probation, or serving a sentence, for any other offense, anywhere. Applicants must wait one year following a misdemeanor conviction before applying for expungement pursuant to Penal Code section 1203.4a.

What if I am Still on Probation? Can I Get an Early Expungement?

Many people who have been convicted of a crime find that once they have completed all the terms of their probation, other than finishing their probation time, they are ready for a fresh start as soon as possible. In these situations, you can petition the court for an early termination of probation. Once probation has been terminated, then you can petition for an expungement. The reality is that an experienced expungement attorney knows how to do these at the same time. If you are still on probation, but you are ready to put it behind you, by seeking an expungement, call us. We can petition for early termination of probation and seek the expungement all at the same time. This will save you time and money.

Can Felony Convictions be Expunged?

The answer to this question is, “Yes!”  California Penal Code section 1203.4  provides for the dismissal of most felony convictions. If you have been convicted of a felony, hope is not lost.  Let us petition the court for you, to get that conviction dismissed!  In addition to expungement under penal code section 1203.4,  Penal Code section 17b provides a way for certain felonies to be reduced to misdemeanors retroactively.   Thus we have two ways to attack an old felony conviction.  We can petition to have it reduced, AND we can petition to have it expunged.  An experienced expungement attorney knows how to do this. Call us today and we will be happy to petition the court to have your felony conviction reduced, then dismissed.

If you were convicted of a felony and were not placed on probation, but rather went to state prison and were subsequently placed on parole, then you are most likely ineligible for the legal relief described above.

Proposition 47 Provides Dramatic Releif to Many People Convicted of Felonies.

In November 2014 California voters passed proposition 47. This is a new law that changes many felonies to misdemeanors and applies retroactively. Likewise, unlike an expungement, one need NOT wait until probation is completed to get relief from Proposition 47. In fact, if you are on probation for a qualifying proposition 47 charge, you can be re-sentenced AND get your felony reduced to a misdemeanor. For a list of qualifying charges click “here”

If you were convicted of a felony and were not placed on probation, but rather went to state prison and were subsequently placed on parole, then you are most likely ineligible for the legal relief described above.

Don’t Be Fooled By Nationwide Expungement Firms- Pick a Local Firm For Best Results.

There are some nationwide expungement law firms that offer too good to be true pricing like “Start for $49”. In our opinion, you will be most likely to get the results and the service you want by selecting a local Sacramento expungement law firm to help you. Local attorneys know the judges, they know the DA’s, they know the probation officers who are involved in the process of an expungement. Local attorneys know how to get the best results in your local market. Further, nationwide mega firms are typically unable to provide personalized excellent service.  For best results at successfully securing a Sacramento expungement, hire a local expungement lawyer. Besides, once you cut through the gimmick pricing, we are often more affordable than the nationwide mega firms.

What Are My Options for Cleaning My Criminal Record?

You have a few different options when it comes to cleaning your criminal record. The most commonly used options are the request for early termination of probation, the misdemeanor expungement, and the Penal Code Section 17b reduction of a felony to a misdemeanor. In addition to those options, there is a way to have arrest records sealed so that back ground checks no longer show that you were arrested by the police. In addition there is a certificate of rehabilitation which helps rehabilitate a criminal record for one who has previously served time in prison or been on parole.
