Auburn  /  Criminal defense

Auburn Criminal Defense Attorney.

I defend criminal defense cases in Placer County and have done since 1999. What you have been charged with, what happens next, and what can still be changed.

Choosing the best criminal defense attorney in Auburn.

If you are looking for a criminal defense attorney in Auburn, start with the question that matters most: who will actually be handling your case? I am Chris Parkhurst, Esq. I have been defending cases in Placer County since 1999, and my State Bar number is 203402. You work with us directly rather than with an intake team or a call center.

What that means in practice is straightforward. I read your file before I tell you what I think of it, I explain what it actually supports, and I give you the realistic range of outcomes rather than the encouraging end of it. For the detail on the charge itself, see criminal defense. To find out what happens next in your case, call.

Criminal defense charges I defend.

These are the criminal defense matters I handle for clients in Auburn and across Placer County.

If your charge is not listed, call me. Working out what you are actually facing is the first useful thing that happens.

What I look at first.

What I examine first in a criminal defense case out of Auburn:

  • Whether the stop or the detention was lawful
  • Whether the search was valid, and whether its scope was exceeded
  • Whether each count charged is actually supported by the report
  • The gap between what the report describes and what the footage shows
  • Whether an enhancement has evidence behind it or was simply attached
  • What evidence exists now that will not exist in twelve weeks

None of that happens on its own. It happens because somebody asked for it early, while it still existed.

Who arrested you in Auburn.

Auburn Police Department. 1215 Lincoln Way, Auburn, CA 95603. (530) 823-4237.

  • California Highway Patrol. Interstate 80 and Highway 49, both of which pass through the city.
  • Placer County Sheriff. the surrounding foothill communities and the unincorporated areas immediately outside the city.

Auburn is small but carries a great deal of through traffic, because Interstate 80 and Highway 49 both pass through it. Most arrests are traffic stops on those two routes or late-night calls out of Old Town Auburn. The city is also the county seat, so the courthouse, the District Attorney's office and the main jail are all here, which is unusual among the cities I cover.

Where a Auburn case is heard.

A criminal defense case arising in Auburn is prosecuted by the Placer County District Attorney and heard in Placer County. The date and location printed on your citation or release paperwork is the authority rather than anything on this page.

How this office charges cases and what happens between arrest and arraignment is set at county level. See Placer County.

Areas I serve around Auburn.

Auburn is compact, and the unincorporated edge begins quickly.

  • Old Town Auburn. the historic centre, with the licensed premises that generate most late-night calls.
  • Lincoln Way. the main commercial corridor, running past the police department itself.
  • Highway 49 corridor. the route south toward the foothill communities, and a common stop location.
  • North Auburn. largely unincorporated, where the Sheriff responds rather than Auburn PD.

I also cover Rocklin, Lincoln, Roseville.

Auburn questions I hear most.

What is the difference between being arrested and being charged?

An arrest is made by police. A charge is filed afterwards by the District Attorney, who reviews the report and decides independently what to file and whether to file at all. People are released without charges regularly.

What is a wobbler?

An offence chargeable as either a felony or a misdemeanour. A great many California offences are wobblers. Which way it is filed, and whether a felony can later be reduced under Penal Code 17(b), affects firearm rights, employment and immigration more than the sentence usually does. See theft and property crimes.

Can a case be resolved without a conviction?

Sometimes. Diversion, deferred entry of judgment and dismissal all exist, and eligibility is narrow. It is worth checking immediately, because eligibility is more often lost by waiting than refused.

Is there a criminal court in Auburn?

Yes — Auburn is the county seat, so the court is here.

Do I have to appear in court myself?

For most misdemeanours an attorney can appear on your behalf. Felonies generally require your presence. Which applies depends on the charge, so it is worth asking early rather than assuming.

What does defending a criminal defense case in Auburn cost?

It depends on the charge, whether it is a misdemeanour or a felony, and whether the case is likely to resolve or be tried. Call and I will tell you what representation in your situation would cost before you commit to anything. For the general picture, see what a criminal defence lawyer costs in California.

The Law Offices of Christopher Parkhurst exceeded my expectations. Attorney Kit Parkhurst was extremely responsive and professional from the very beginning. I contacted his office on behalf of a family member, and he responded within seconds to offer a free consultation. Remarkably, he was able to resolve the case the very same day.
All communication was handled efficiently by phone and email, and we did not even need to appear in court. He later called to confirm that the case was resolved and all charges had been dropped.
Attorney Parkhurst is highly knowledgeable, professional, friendly, compassionate, and honest. His pricing was also very affordable. I highly recommend his services to anyone in need of legal representation.

From the beginning they were very responsive, professional, and made sure I understood every step of the process. Their experience and strategy made a huge difference and they were able to negotiate a significantly better outcome than what I was originally facing. On Saturday April 3, 2026 I was arrested for a domestic violence charge and given my first court appearance on April 7, 2026

Due to the weekend and Easter I was unable to get help from an attorney. When I called and found Kit on Monday April 6, 2026, he immediately picked up the phone and assured me I was in good hands and could help.

Kit could hear my stress level and told me several times everything would be fine. Kit then explained his plan of action and on April 7, 2026 at 1100 hours Kit called me stating he spoke to the DA and the charges would not be filed.

If it wasn't for Kit's approach, knowledge and claming personality not sure what my outcome would of been.

I hope no ever gets fasley arrested, but if you do, do not hesitate to call Kit and let him work for you.

Lastly I just want thank God for bringing this talented, non-judgemental Attorney into my life when I needed someone to help.

I found myself in a situation where I was facing charges.
The morning after Christmas I had arraignment and was petrified of what was about to happen.
I called several Law offices, Chris picked up and quickly gave me a huge feeling of relief.
He knew what was happening in the back scenes and explained how we should go about figuring it out.
He made one phone call and informed me my case was dropped.
I truly can't thank him enough!
What a great guy, I would recommend him to anyone.
I wanted to post on all channels, it's beyond real and deserved.

Seriously Chris you went out of your way to help me and I appreciate it so much! Ill never forget it.
